Artikel 1 – Algemene voorwaarden en begripsbepalingen
Deze algemene voorwaarden zijn van toepassing op een tijdelijke huurovereenkomst tussen verhuurder ‘Le Petit Garem’ – hierna verhuurder – en de huurder(s) van één of meerdere gîtes.
Tenant: the person who rents the gîte from the landlord for a specific time and has paid the agreed rent to the landlord.
Landlord: the owners of Domaine Le Petit Garem, being the one who rents the vacation home to the tenant.
Rental agreement: agreement between the tenant and the landlord regarding the rental of a gîte.
Huurprijs: prijs per in de overeenkomst bepaalde periode. De huurprijs kan vermeerderd worden met kosten en borgsom.
Advance: the portion of the rent owed by the tenant to the landlord upon booking.
Deposit: amount the tenant pays in advance to the landlord for any expenses, damage or loss for which the tenant is responsible.
Arrival and departure times: the times agreed upon between tenant and landlord depending on the rental period.

Article 2 - Reservation
2.1 Upon receipt of your telephone, written or electronic reservation request, you will receive by e-mail from the landlord the reservation document containing relevant information for the stay in the booked gîte and your personal data.
2.2 In the interest of proper booking and to avoid misunderstandings, the Lessee undertakes to immediately report to the Lessor the correctness and completeness of the data and any incompleteness or inaccuracies within 24 hours of receipt of the reservation confirmation. If no such notification is made within the specified period, the lessee is not entitled to invoke the incompleteness or inaccuracy of the booking confirmation.
2.3 The landlord informs the tenant about the rented cottage, the rental price and the general conditions. After the timely payment of the deposit, the reservation is final and the tenant agrees to the general reservation conditions.
2.4 Pets are not allowed.

Article 3 - Rental period
3.1 In the months of July and August, rentals are in principle per week.
- The rental period begins on the first Saturday from 16:00 and ends on Saturday at 10:00.
3.2 Outside the period of July and August, it is also possible to rent for shorter periods after mutual agreement.
3.3 The expected time of departure should be communicated by the tenant in good time to the owner who will inspect the gîte with the tenant before departure.

Article 4 - Terms of payment
4.1 Within two days after the sending by e-mail of the reservation document, the deposit, mentioned therein, must be paid. The balance of the rent must be paid by bank transfer at least two weeks before the start of the rental period.
4.2 No changes can be made by the lessee to a booking made other than after consultation with and approval of the lessor.
Payment by debit card is not possible.

Article 5 - Security deposit
5.1 Upon payment of the balance, a deposit of 400 euros for gîte Le Petit Garem and 200 euros for La Maison des Hobbits must be paid.
5.2 The security deposit will be refunded seven days after the end of the rental period, less any additional cleaning, any additional energy costs and/or damage costs.

Article 6 - Energy
Normal consumption of electricity is included in the rental price. More consumption, for example for heating or electric charging will be charged separately at the end of the rental period and deducted from the refundable deposit.

Article 7 - Tourist tax
The tourist tax for persons over 18 years old is 5% of the rental price and is paid upon reservation.

Article 8 - Cancellation and modification by the Lessee
8.1 A cancellation must always be reported to the Lessor in writing (by e-mail) and is only valid after confirmation by the Lessor.
8.2 In case of cancellation of the rental agreement, the following conditions apply:
- In case of cancellation less than 14 days before the start of the rental period, the deposit remains due and will not be refunded.
- In case of cancellation less than 7 days before the start of the rental period, the full rental price will be due.
- The tourist tax will not be refunded.
8.3 In case of late arrival or early termination of the stay, the full rental price remains due.
8.4 Changes to a confirmed booking are only possible after consultation with and written approval by the Lessor.
8.5 The landlord recommends that the tenant purchase travel and/or cancellation insurance.

Article 9 - Cleaning
The gîte must be left tidy at the end of the rental period. Failure to do so may result in an additional charge on the final cleaning.
This includes:
- Broom-clean
- Everything washed clean, dried and placed back in the cupboards
- Garbage bags in the container, empty bottles and waste paper in the designated place
- Quilts and any linen folded at the foot of the bed
- Refrigerator empty and clean
- All food and drink items have been removed.

Article 10 - Kitchen, bath and bed linen.
One set of bath, bed and kitchen linen per person per week is provided. It is possible to rent additional sets; rates are available on site.

Article 11 - Obligations of the landlord.
The landlord shall ensure that the gîte is made available to the tenant at the agreed time in good condition and in accordance with the booking confirmation.

Article 12 - Obligations of the renter.
12.1 The Lessee is legally liable for damage caused by himself or his fellow guests to the accommodation or the items therein. Damage must be reported to the Lessor immediately.
12.2 Tenants may park their vehicles in the parking lot provided by Landlord. Parking is entirely at your own risk.
12.3 Upon arrival, the tenant is obliged to inspect the gîte and its immediate surroundings together with the landlord.
12.4 Overnight stays in the gîte are only allowed for the number of persons as stated in the rental confirmation. Only those persons specified at the time of booking are entitled to stay in the gîte, unless the landlord has given his express prior consent.
12.5 Overnight accommodation of additional persons is only permitted with the prior consent of the landlord and upon payment of any agreed surcharge. The tenant is responsible for all persons who are in the gîte with his/her consent.
12.6 In case of violation of the above provisions, the landlord has the right to terminate the rental agreement with immediate effect and to refuse access to the gîte. In that case, the tenant remains liable for the full rental price. The landlord is then entitled to re-rent the gîte.
12.7 The gîtes and the domain are completely smoke-free.

Article 13 - Termination or modification of the lease by the landlord.
The landlord is entitled to terminate or modify the lease in the following cases:
13.1 If the tenant fails to pay the advance payment due (on time).
13.2 In case of force majeure, both temporary and permanent. In such case, the Lessor shall be entitled to terminate or suspend the lease in whole or in part, without the Lessee being able to claim performance and/or compensation for damages.
Force majeure includes, but is not limited to: threat of war, war, insurrection, strikes, boycotts, disruptions in energy supply or transport, government measures, scarcity of raw materials, natural disasters, extreme weather conditions, death of the owner, divorce of the owner, as well as unexpected sale or commissioning of the accommodation by the owner. The Lessor shall not be liable for any damages suffered by the Lessee as a result of such termination or modification.

Article 14 - Liability.
14.1
The Lessor is not liable for damage suffered by the Lessee or third parties as a result of staying in the accommodation. The Lessee indemnifies the Lessor against claims from third parties in this regard. Nor is the Lessor liable for disturbances in and around the accommodation, such as failure of power and water supplies, technical installations, construction work not announced or not announced in time and changes to access or main roads.
14.2 The Landlord shall only be liable for damages resulting from the Landlord's willful intent, gross negligence or negligence.
14.3 The landlord accepts no liability for theft, loss or damage of any kind suffered by the tenant during or as a result of the rental and stay in the gîte.
14.4 Without prejudice to the foregoing, the Landlord's liability, if and insofar as it is held liable, shall be limited to direct damage. Consequential damage is excluded. Liability shall in all cases be limited to the amount paid out by the lessor's insurer.

Article 15 - Complaints
15.1
The landlord guarantees a correct description of the accommodation. Minor deviations are considered acceptable. Descriptions and impressions of the accommodation and its immediate surroundings, including amenities, furnishings and recreational facilities, may vary from the information on the website due to their nature, interim changes or seasonal influences. This information is partly subjective.
15.2 The Lessee is entitled to submit a complaint to the Lessor. The Landlord shall deal with complaints adequately and expeditiously, in accordance with the standards of reasonableness and fairness.
15.3 Complaints that arise on arrival or during the stay must be reported to the landlord no later than 24 hours after their determination. The landlord will make every effort to resolve the complaint on site as soon as possible.
